• Distributing of any spyware, trojans, spybots, worms, any malicious code viruses, or any form of malware including and not excluding keyloggers, logic bombs, droppers, hidden files, clocks, locks, copy protection features, upload files intent on harming the Site, the SErvices and the users or visitors of the Services

The Company, its affiliates, and licensors are not liable for any damage or loss that the User, or third party in contract, tort, negligence, or otherwise, incur through the use of the Services provided in the Site whether it be directly or indirectly.

The Company, its affiliate, and their licensors are not liable for any damage or loss that may arise in any way connected with the use of any link contained on the site nor are they responsible for the content contained on any internet site linked from the Site.

The Company shall not be liable to you or any third party for any amendments to, suspension of, or discontinuation of the Site or the Service.

The User, by using the Site and its Services provided, agrees to fully indemnify, defend and hold the Indemnified Parties (the Company, its officer, directors, employees, agents, censors, and suppliers) harmless from and against and all claims, liabilities, proceedings, damages, losses, fines, costs and expenses of any kind which include but not limited to legal fees from:

• All breaches of the Agreement.
• Your, or third party, access and use of the Site and its Services.
• Violation and contravention of any law and/or legislation.
• Negligence committed by the User.
• Willful misconduct by the User (collectively “Claims”).

The User agrees to:

• Notify the Site immediately of any Claim.
• No Claims will be settled without prior consent from the Company.
• Indemnified Parties will have the right to defend against any Claims made by the User – who in turn will be cooperative and provide information and assistance on the Claim.

The User has the right to defend a Claim with counsel to the Indemnified Party, subject to the Indemnified Party’s right to assume, at their sole cost and expense, the defence of any Claim at any time before the settlement or final determination.

The User has to be aware that the Site will contain hyperlinks to other sites. The Company will not be held liable for the information contained in the linked site as content on other sites is beyond the control of this Site. It is the responsibility of the User to read the terms and conditions of the linked site and verify the information contained in the link.

The Company, its affiliates, and/or licensors reserve the right to make changes to the Terms and Conditions of the Site Content without prior notification to the User. We request the User to, on occasion, revisit the Terms of the Site regularly to keep informed.
